does a great job of explaining why the Court should have gone further in the "faith-based initiative case," which is really a case about the limits of the Court's power to decide policies when nobody has a real legal injury to bring before it. (To pre-empt emails: Yes, I know he gets the date of Marbury v. Madison wrong.)
