Illegal Advice [Ramesh Ponnuru]
I'm a little puzzled by the talk of prosecuting the writers of legal memos on torture. It seems hard to believe that you would ever be able to prove that they knowingly misdescribed the law. And if they sincerely believed the law to say what they said it said, then of what offense could they be guilty?
