Well, yes and no, Kathryn. If what took place took place between two freely consenting adults then it definitely should have been a private matter rather than a concern of the state, not that Spitzer himself, as prosecutor, ever seems to have recognized that fact. He may be a hypocrite, but the law, in this respect, is, to use a possibly unfortunate turn of phrase, an ass.
